The Pinocchio Files© is a web site created, coordinated and maintained by The Somniloquy Institute, P.O. Box 25321, 3001 HH Rotterdam, the Netherlands.
The Pinocchio Files web site presents a free articles database for all who wish to learn more about truth and lies, and learn how to recognize them. We support the Blue Fringe Campaign for free speech. Our goal is to create an entertaining and educational environment which also means a place where we don't tolerate behavior that can be harmful to others.
This chapter provides a framework and basic rules by which we all agree to help support the creation of a free, inviting and vibrant place for popular science and infotainment. So, please read our ideas and if this is something you can live with, we are happy to welcome you to a universe in which the truth is the truth and a lie a lie. If you have questions or suggestions, please send us some feedback.
The Pinocchio Files User Agreement:
The Pinocchio Files web site is provided by The Somniloquy Institute, as a free service to users who agree to abide by the following terms and conditions. The Somniloquy Institute reserves the right to change the nature of this relationship at any time and for any reason. Any user who violates the terms of this Agreement is no longer welcome in the Pinocchio Files.
Rules for the Pinocchio Files:
You are entirely responsible and liable for all activities conducted through this web site. Here is a list of some of the violations we don't support. You agree not to do any of the following while in or using the Pinocchio Files.
(1) harass, threaten, embarrass or cause distress or discomfort upon another Pinocchio Files user, or other individual or entity;
(2) transmit any information, data, text, files, links, communication or other materials that The Somniloquy Institute considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, perverse, sick, sexist, hateful, spiteful, racially or otherwise objectionable;
(3) impersonate in the Pinocchio Files any person, including but not limited to a contributing official or citizen, and;
(4) violate any applicable local, state, national or international law in the broadest sense possible.
YOU EXPRESSLY AGREE THAT USE OF THE Pinocchio Files IS AT YOUR OWN RISK. The Somniloquy Institute IS NOT RESPONSIBLE TO YOU FOR ANY CONTENT STORED IN THE Pinocchio Files. The Somniloquy Institute EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. The Somniloquy Institute MAKES NO WARRANTY THAT THE Pinocchio Files WILL MEET YOUR REQUIREMENTS, OR THAT THE Pinocchio Files WILL BE UNINTERRUPTED, TIMELY, SECURE, COMFORTABLE OR ERROR FREE.
LIMITATION OF LIABILITY:
TO THE FULL EXTENT PERMISSIBLE UNDER THE APPLICABLE LAW, The Somniloquy Institute SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL HARM OR DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THE Pinocchio Files OR FOR COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE Pinocchio Files OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF PROFITS, USE, DATA, OR OTHER INTANGIBLE PROPERTIES, EVEN IF The Somniloquy Institute HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH HARM AND DAMAGES.
INDEMNIFICATION:
You agree to defend, indemnify and hold harmless The Somniloquy Institute, its affiliated projects, its employees, contractors, officers and directors, from all liabilities, claims and expenses, including attorney's fees, that arise from breach of the terms of this Agreement, or in connection with, the transmission of any Information on the Pinocchio Files and The Somniloquy Institute.
MISCELLANEOUS:
This Agreement shall be governed by and construed in accordance with the laws of the kingdom of the Netherlands, and you agree to submit to the personal jurisdiction of the courts of the Netherlands for any cause or action arising out of this Agreement. In the event that any portion of this Agreement is deemed by a court to be invalid, the remaining provisions shall remain in full force and effect. |
