Fabricating evidence |
I left the room for five minutes, and gathered up some bogus reports. I placed them in a file folder, and put Larry's name upon the folder where it could be easily seen. As I remember, the reports were of old cases and shit like barking dog complaints. Nevertheless, it looked sort of impressive. I then came back into the room. I stood with my feet and hands about shoulder width apart, displaying a confident stance and holding the file folder so Larry could read his name upon it. I then said this to him:
"Larry, our investigation clearly shows that you did have sex with P. (the victim). I'd like to sit down and talk to you about this. Will you talk to me?"
Larry did not make denial, but merely started sobbing and asked:
"Is all that information in the folder about me?!"
His body language was one of defeat, and this further strengthened my belief that the pervert was guilty of this crime and that he should pay for it. I sat down and began introducing a theme that I thought he would be receptive to. I told Larry that I thought he had committed this crime by accident, that it had only happened because he was lonely, and that a real man has his needs too. I repeated this theme, not giving Larry a chance to make objections, and built upon the theme as I went along. |

Working towards a full confession |
Not wanting him to fully cry (that would allow him to release too much emotional tension), I moved into the next phase of the interrogation. I asked Larry a question that gave him a good reason for abusing the girl. What I specifically him was this:
"Larry, we've talked for a while. I think I know a little about you, and feel that you're a good man at heart. Larry, what I have to ask you is this: did you abuse P., or did you just make a mistake that you now regret? Larry, if you abused her, I don't want to talk to you. But if this was an accident that happened because you were lonely, we need to know that. It was just a mistake on your part, wasn't it, Larry? You were just lonely, and she agreed to do it, right? Is that it, Larry?" |
By now I was really enjoying my part. Larry immediately agreed with me, and stated that it had been an accident and that he not meant for the abuse to take place. Shortly thereafter, Larry gave a full confession. He was arrested and ultimately convicted of sexual battery upon a child. Unfortunately, the pervert was only placed on probation for ten years and forced to undergo some vague psychological treatment. While it was my opinion that he should have been fried, but his lack of a previous criminal record and age worked in his favor. | |

Case analysis |
To analyze Larry's interrogation, we have to look at the principles involved that made it a success:
Principle Number One
First, sound interviewing skills were utilized. Remembering that people like those who are most like themselves, I was able to take a few things I knew about Larry and use them to my advantage. He was obviously lonely, he had problems with women and he liked to fish. By pretending to have the same problems and interests, I was able to get Larry to think I was like him. Establishing rapport was easy after that. When it became time to get to the actual meat of the interrogation, I utilized several different techniques:
a. Through reading his body language, I believed that he had committed the crime.
b. I used a Bait Question that implied to Larry that I had physical evidence that linked him to the crime.
c. I accused him of committing the crime in a positive, confident manner.
d. I used a theme that Larry appeared to accept.
e. And lastly, I gave Larry a better image of himself by portraying him not as a child molester, but as a lonely old man who had made a mistake.
Principle Number Two
Sympathy should be shown at every point in a interview. Even the most despicable pervert wants to believe that he is okay. Like Adolph Hitler thought he was doing the world a favor. Although we know Hitler and his kind to be evil, we cannot condemn such people and expect them to confess to us. At no time can a professional interviewer show feelings of disgust towards a pervert. We must be careful to hide our true emotions, and pretend to sympathize with the criminal - even if he is so vile a creature as a child molester. Our satisfaction comes from locking these people up. Larry was repulsive to me, but he thought I liked and understood him. That is our objective.
Principle Number Three
You must be able to express confidence in your assertions. If you do not act confident in your beliefs, the suspect will realize this and will not confess. You must portray yourself as being confident not only in the suspect's absolute guilt, but in your ability to prove it. By doing this, you can make the suspect doubt his chances of escaping justice and make him feel that his best chance of minimizing his punishment is to confess. Just like a good car salesman can make a sale to almost anyone, a professional interrogator sells a suspect a confession. But if you aren't confident, it is not going to happen. Cold interviews are not fun, but they can be handled in such a manner that they can be productive.
Larry's interview started at a zero chance of conviction, little information and then speeded up to a full confession in less than twenty minutes. The satisfaction I gained by getting the confession in that case was only beaten by listening to his conviction as it was pronounced by the judge. I hope you do equally as well in your situation! |
